The applicant sustained a construction injury when he was knocked into a hole and a machine fell on him. His injuries were severe, involving not only orthopedic damage but also internal and psychological harm. He was transported by ambulance to the hospital, where he lost a significant amount of blood. Prior to our representation, the defendant denied psychological, neurological (blood loss causing cognitive issues), internal, urological, and dermatological treatment.

Upon signing the applicant, we immediately went to work and scheduled him with numerous specialists across multiple disciplines. Shortly thereafter, the defendant made an initial settlement offer of $300,000, which was denied. After further discovery, the defendant increased the offer to $500,000, which was also denied. Due to circumstances outside of our control, the applicant later requested that the claim be settled.

We worked around the clock to assess the potential exposure related to the applicant’s permanent disability and future medical care. A Medical Set Aside was obtained in the amount of $250,000. Through continued negotiation, we secured a settlement of $2,000,000, with $100,000 in permanent disability advances waived for the applicant.
